THIS PRIVACY POLICY CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU, AS A USER OF THE PLATFORM AND US, AS THE OWNER OF THE PLATFORM. YOU MUST BE A NATURAL PERSON WHO IS AT LEAST 18 YEARS OF AGE OR LEGAL PERSON WHO ACCESSES OR USES THE PORTAL (DEFINED BELOW) AND IN THE EVENT THAT A NATURAL PERSON IS REPRESENTING A BUSINESS ENTITY OR A BODY CORPORATE, REFERENCE TO SUCH TERMS SHALL INCLUDE A REFERENCE TO SUCH BUSINESS ENTITY AND/OR BODY CORPORATE AS WELL AND OTHER PROMOTERS OF SUCH BUSINESS ENTITY AND/OR BODY CORPORATE.

1.6 The latest version of the Privacy Policy will always be available on our Platform, and we encourage you to review it periodically to stay informed of any updates. Your continued use of the Platform constitutes your acknowledgment of an agreement to any changes made to the Privacy Policy.

a. Our Platform and services are intended for use only by individuals who are 18 years of age or older. We do not knowingly collect, solicit, or process personal information from anyone under the age of 18.

Please be advised that any Information (as defined herein below) procured by us, shall be:
(a) processed fairly and lawfully for rendering the services set out on the Platform ("Services");

(c) adequate, relevant and not excessive in relation to the purpose for which it is required;

(f) This Privacy Policy does not apply to information that You provide to, or that is collected by, any third-party, such as lenders/financing partners who provide credit facilities ("Financial Institution"), Account Aggregators ("AAs"), Financial Information Provider ("FIP"), Financial Information User ("FIU") or merchants from which You avail any services. - YOUR CONSENT
4.1 By accessing or using the Platform, submitting any information through the Company's Platform, or otherwise interacting with the Company, you acknowledge and consent to the Company collecting and processing limited personal information directly provided by you or automatically generated through your use of the Platform, strictly for purposes such as enabling access to the Platform, responding to queries, facilitating communications, maintaining platform security, monitoring performance, ensuring compliance with applicable law, and other purposes expressly set out in this Privacy Policy.
4.2 You further acknowledge and understand that, in its role as a Technology Service Provider ("TSP"), the Company may receive certain information from AAs, FIPs, and/or FIUs solely for the purpose of providing technical, operational, and support services to such entities. The Company processes such information strictly on the instructions of, and on behalf of, the relevant AA, FIP, or FIU and does not independently determine the purpose or means of processing such information.
4.3 You acknowledge and consent that, to the extent necessary to provide its services to AAs, FIPs, and FIUs, the Company may share or transfer such information to its authorised subcontractors or sub-processors, including cloud service providers, infrastructure partners, technology vendors, security service providers, and analytics tools (limited to operational and security analytics). Such subcontractors or sub-processors are engaged under appropriate contractual arrangements and are permitted to process such information solely to enable the provision of services to the relevant AA, FIP, or FIU and for no other purpose.
4.4 The Company does not use any information received from AAs, FIPs, or FIUs for independent commercial purposes, including marketing, advertising, or profiling, and does not disclose such information except as required to provide services, comply with applicable law, or as expressly instructed by the relevant AA, FIP, or FIU.
4.5 If you do not agree with this Privacy Policy, you may choose not to access or use the Platform. Where consent is not provided or withdrawn, the Company may be unable to continue providing access to certain features or services.
4.6 You may withdraw your consent or exercise any rights available to you under applicable law by writing to the Company at info@ignosis.ai. Withdrawal of consent shall not affect the lawfulness of any processing carried out prior to such withdrawal and may impact the Company's ability to provide services.

6.3 Aggregating Information / Anonymized data: We may aggregate Information and analyse it in a manner to further accentuate the level of services that we offer to our customers. This Information includes average number of Users of the Platform, the average clicks of the services, the features used, the response rate, etc. and other such statistics regarding groups or individuals. In doing so, we shall not be making disclosures of any Personal Data as defined above.
- DISCLOSURE AND SHARING OF INFORMATION
7.1 We do not rent, sell, or disclose or share any Information that we collect from you, with third parties, save and except as mentioned below or permitted under applicable law.
7.2 We may share your Information in circumstances and for the purposes as specified hereunder:
(a) We shall share the Information with AAs, FIPs, FIUs and other relevant financial institutions solely to enable and facilitate the provision of services requested by you, including where you have chosen to access or avail services that require interaction with, or information exchange between, such AAs, FIPs or FIUs. Such sharing is limited to the minimum data necessary to enable these entities to provide the requested services and to give effect to your instructions and consent.
(b) When compelled by law, we may disclose any Information provided by you on the Platform as may be deemed to be necessary or appropriate:
- under applicable law, including laws outside your country of residence;
- to comply with legal process;
- to respond to requests from public and government authorities outside your country of residence;
- to protect our operations or those of any of our affiliates;
- to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others;
- to allow us to pursue available remedies or limit the damages that we may sustain;
- to protect against legal liability;
- to protect the personal safety of Users of the Platform;
- to prevent or investigate possible wrongdoing in connection with the Platform.
(c) Merger or Acquisition: We may share Information upon merger or acquisition of Company with another company. We shall transmit and transfer the Information upon acquisition or merger of Company with another company.
(d) With our service providers: We may share limited Information with our service providers, subcontractors and technology partners solely on a need-to-know basis and only where such sharing is required to enable the provision of the services requested by you. Our Platform and Services are not meant for use by children and we knowingly do not collect Information of/from children. If it comes to our notice that we have collected Information from/of children, we shall take steps to remove such Information from our servers. - CONTROL THE COLLECTION OR USE OF THE INFORMATION

- RETENTION OF INFORMATION
All Information provided by you, save and except upon withdrawal or termination, shall be retained in locations outside the direct control of Company (for instance, on servers or databases co-located with hosting providers). We will delete Information based on a request received from you within a reasonable period and latest within 90 (ninety) days of receiving a deletion request. However, we may retain such portion of Information and for such periods as may be required under Applicable Law. Notwithstanding anything contained herein, Company may retain data after account deletion for reasons including but limited to the following purposes: If there is an unresolved issue relating to your account, or an unresolved claim or dispute; If we are required to by applicable law; and/or in aggregated and/or anonymized form; or Company may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing Users' safety and security.
- COOKIES AND OTHER TRACKING TECHNOLOGIES
13.1 Our Platform may utilize "cookies" and other tracking technologies such as Google Analytics which may collect your Technical Information and Non-Personal Information. "Cookies" are a small text file consisting of alphanumeric numbers used to collect the Information about Platform activity. The Technical Information helps us analyse web traffic and helps you by customizing the Platform to your preferences. Cookies in no way gives us access to your computer or mobile device. In relation to Cookies, you can deny access to the installation of the Cookies by modifying the settings on your web browser, however, this may prevent you from taking full advantage of the Platform.
13.2 Our use of Cookies and Technical Information allows us to improve Platform and your experience of Platform and Services. We may also analyse Technical Information that does not contain Personal Information for trends and statistics.
- USE OF INFORMATION AND THIRD-PARTY SERVICES
14.1 You understand and agree that AAs, FIPs, and FIUs may collect, access, process, and share Information strictly in accordance with the explicit consent of the relevant data principal and applicable laws. Such Information is collected and processed by the relevant AAs, FIPs, and FIUs in accordance with their respective legal and regulatory obligations.
14.2 Ignosi acts as a TSP within the AA ecosystem and does not independently determine the purpose or means of processing of Information exchanged between AAs, FIPs, and FIUs. Ignosi's role is limited to providing technical and operational support to enable secure, consent-based data flows. Accordingly, Ignosi shall not be responsible or liable for the collection, use, disclosure, processing, or storage of Information by AAs, FIPs, or FIUs, except to the extent expressly required under applicable law.
14.3 Notwithstanding the above, Ignosi may collect and process limited personal information directly in connection with access to or use of its website or Platform. Such information may include, without limitation, name, designation, organisation details, contact information, login credentials, technical identifiers (such as IP address, device or browser information), usage logs, and communications exchanged with Ignosi. This information is collected strictly on a need-to-know basis and processed solely for legitimate purposes, including enabling platform access, user authentication, service delivery, security monitoring, troubleshooting, analytics, compliance with legal obligations, and communication with relevant stakeholders.
14.4 Ignosi does not collect or process Information of end customers for its own independent purposes and does not use any information available to it for profiling, marketing, or advertising, except as may be expressly permitted under applicable law.
14.5 To support the provision of its services, Ignosi may engage third-party service providers, including cloud service infrastructure providers, technology vendors, analytics providers (limited to operational, performance, and security analytics), and payment gateway providers. Such third-party service providers are engaged under appropriate contractual arrangements and are required to implement reasonable technical and organisational safeguards consistent with applicable laws and recognised industry standards.
14.6 Ignosi undertakes reasonable and appropriate measures to ensure that any third-party cloud service infrastructure providers engaged by it maintain adequate security safeguards for the protection of information processed on Ignosi's behalf. Ignosi shall not be liable for any data breach or security incident attributable to such third-party service providers where such incident is beyond Ignosi's reasonable control, except where such breach arises directly due to Ignosi's proven negligence or wilful misconduct.
14.7 In addition to the safeguards implemented by third-party service providers, Ignosi employs appropriate physical, managerial, technical, and operational security measures, in accordance with industry standards and established best practices, to protect information processed by it in its capacity as a TSP. Ignosi follows reasonable security practices and procedures and utilises secure systems and servers as required under applicable law.
14.8 Ignosi maintains an information security management framework and is ISO-certified, reflecting its commitment to recognised information security standards. Ignosi periodically reviews and updates its information collection, storage, and processing practices, including physical and logical access controls, to safeguard against unauthorised access, alteration, or misuse of its systems.
14.9 Notwithstanding the foregoing, you acknowledge that no method of electronic transmission or storage is completely secure. While Ignosi endeavours to protect information using commercially reasonable safeguards, it cannot guarantee absolute security of its systems or that information transmitted over the internet will not be unlawfully intercepted or accessed. You acknowledge and accept the inherent risks associated with data transmission over the internet.
14.10 Further, where you are redirected to, or interact with, any third-party website, platform, or service, the collection, processing, and storage of information by such third parties shall be governed by their respective privacy policies and terms of service, which are beyond Ignosi's control.
14.11 Ignosi shall not be responsible for any unauthorised access, disclosure, or misuse of information by third parties, including AAs, FIPs, FIUs, or payment gateway providers, except where such breach arises directly due to Ignosi's proven negligence or wilful misconduct.
- CHANGES AND UPDATES TO POLICY
We may modify or revise the Privacy Policy from time to time and shall accordingly notify you of any changes to the Privacy Policy by posting the revised Privacy Policy on the Platform with an updated date of revision. We shall endeavour to review, revise, update, modify, amend or correct the Privacy Policy on a regular and routine basis, especially whenever a significant update is made to the technology employed by us. You must periodically review the Privacy Policy for the latest information on our privacy practices. In the event you continue to use the Platform and our services after any update in the Privacy Policy, your use of the Platform shall be subject to such updated privacy policy. Your continued usage of Services or access of the Platform post any amendment would deem to mean that you accept and agree to the revised Privacy Policy. 16.2 The Company is committed to implementing this Privacy Policy in accordance with applicable law. Upon receipt of any grievance or complaint, the Company shall acknowledge the same within twenty-four (24) hours and shall use reasonable efforts to resolve such grievance within fifteen (15) days from the date of receipt.
16.3 You acknowledge that the Company shall address and attempt to resolve all grievances in accordance with its internal policies, procedures, and applicable legal requirements. Any dissatisfaction with the outcome or manner of resolution shall not, by itself, be construed as a failure by the Company to address the grievance.

THE INVALIDITY OR UNENFORCEABILITY OF ANY PART OF THIS PRIVACY POLICY SHALL NOT PREJUDICE OR AFFECT THE VALIDITY OR ENFORCEABILITY OF THE REMAINDER OF THIS PRIVACY POLICY. THIS PRIVACY POLICY DOES NOT APPLY TO ANY INFORMATION OTHER THAN THE INFORMATION COLLECTED BY US THROUGH THE PLATFORM. THIS PRIVACY POLICY SHALL BE INAPPLICABLE TO ANY UNSOLICITED INFORMATION YOU PROVIDE US THROUGH THE PLATFORM OR THROUGH ANY OTHER MEANS. ALL UNSOLICITED INFORMATION SHALL BE DEEMED TO BE NON-CONFIDENTIAL AND WE SHALL BE FREE TO USE AND/OR DISCLOSE SUCH UNSOLICITED INFORMATION WITHOUT ANY LIMITATIONS. THE RIGHTS AND REMEDIES AVAILABLE UNDER THIS POLICY MAY BE EXERCISED AS OFTEN AS NECESSARY AND ARE CUMULATIVE AND NOT EXCLUSIVE OF RIGHTS OR REMEDIES PROVIDED BY LAW. RIGHTS UNDER THIS POLICY MAY BE WAIVED ONLY IN WRITING. DELAY IN EXERCISING OR NON-EXERCISE OF ANY SUCH RIGHT OR REMEDY DOES NOT CONSTITUTE A WAIVER OF THAT RIGHT OR REMEDY, OR ANY OTHER RIGHT OR REMEDY.
- INDEMNIFICATION
You shall defend, indemnify, and hold harmless Company, its affiliates/subsidiaries/joint venture partners and each of its, and its affiliates'/subsidiaries/joint venture partners' employees, contractors, directors, suppliers and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to (i) your use or misuse of, or access to, the Services or Platform; or (ii) your violation of the Privacy Policy; or any applicable law, contract, policy, regulation or other obligation. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in connection therewith.
- LIMITATION OF LIABILITY
